Platform operator

The web platform “Single Point of Contact Electronic for the Industrial Licence (PCUEL) of Romania” (hereinafter referred to as the “PCUEL Web Platform”) is administered and operated by the Office for the Industrial Licence (hereinafter referred to as the “Operator” or “OLI”), headquartered in Bucharest, 65 Paris Street, Sector 1, postal code 011815, e-mail: contact@oli.gov.ro; website: www.oli.gov.ro, registered under the unique registration code 50053290.

The Operator is responsible for administering the PCUEL Web Platform and its services in accordance with the applicable national and European legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The Office for the Industrial Licence is required to process, under secure conditions, the personal data provided by the Platform users.

The Operator is responsible for complying with the principles of transparency and good digital governance, as well as for preventing and remedying any incidents that could affect the proper functioning of the PCUEL Web Platform or the security of users’ data.

Definitions

PCUEL Web Platform” means the official website https://pcuel.oli.gov.ro/, operated by the Office for the Industrial Licence, and all digital services available through it.

Service” means any functionality, application, electronic form, communication tool or information made available to users through the PCUEL Web Platform.

User” means any natural or legal person who accesses the PCUEL Web Platform, regardless of whether they register or use the services anonymously.

Account” means the profile created by the user to access restricted functionalities, which involves authentication and personalised data management.

Content” means all information, documents, images, texts, forms, graphic or multimedia materials made available to users through the PCUEL Web Platform.

Operator” means the public institution that administers the platform and processes users’ data as a controller, in accordance with Regulation (EU) 2016/679 and related legislation.

Processor” means any entity that processes personal data on behalf of the Operator and in accordance with the Operator’s instructions.

Terms and Conditions” means this document entitled “Terms and Conditions for the Use of the PCUEL Web Platform”.

Acceptance of the terms

By accessing, using and browsing the PCUEL Web Platform, the user expressly agrees to comply with this document and all its provisions.

Acceptance of the Terms and Conditions may be completed by ticking a dedicated checkbox when creating an account or by continuing to use the services of the PCUEL Web Platform, which constitutes proof of tacit acceptance of the terms of use.

Failure or refusal to accept this document prevents the user from benefiting from the services of the PCUEL Web Platform, and the Operator reserves the right to restrict access to functionalities or to suspend accounts that do not comply with this document.

Description of the services

The PCUEL Web Platform provides ongoing access to public information and official documents issued by the Operator, including legislation, regulations, guidelines, forms and informative materials.

The PCUEL Web Platform enables users to complete and submit official electronic forms, as well as to interact with the Operator via secure communication tools.

Registered users benefit from advanced functionalities, such as personalised notifications, viewing the history of requests, and managing their own accounts.

The services of the PCUEL Web Platform may include analysis, reporting and feedback tools to optimise the interaction between the Operator and users.

The Operator reserves the right to modify, restrict or temporarily suspend certain services for maintenance or improvement purposes, with prior user information, where possible.

Account creation and management

Creating an account on the PCUEL Web Platform requires the user to provide accurate, complete and verifiable data.

The user is solely responsible for the security of authentication data and for maintaining the confidentiality of the password and other access credentials.

The Operator may suspend or delete accounts that provide false data, breach the Terms and Conditions, violate applicable law, or affect the platform’s security.

Account recovery in case of password loss or unauthorised access is carried out through identity verification procedures, in accordance with the Operator’s instructions.

The user must notify the Operator immediately upon becoming aware of unauthorised access to their account.

Rules of use

Users must comply with the applicable law and use the PCUEL Web Platform exclusively for lawful and authorised purposes. Publishing illegal, obscene, violent, discriminatory or offensive content is prohibited, as is transmitting information that may infringe third-party rights. It is strictly forbidden to compromise the platform’s security, attempt unauthorised access to other users’ data or to the PCUEL Web Platform infrastructure, or use the PCUEL Web Platform for unauthorised purposes. Automated data collection, scraping or other automated access methods without the Operator’s explicit permission are prohibited. Users may not provide false data or data belonging to other persons without their consent.

Users’ rights and obligations

Users have the right to access the public information available on the PCUEL Web Platform and to exercise all rights granted by personal data protection legislation, including the rights of access, rectification, erasure, objection, data portability, and withdrawal of consent. Users may submit complaints, requests or notifications to the Operator, who is required to respond within the legal time limits. Users must comply with this document, use their authentication credentials responsibly, and refrain from any action that could affect the platform’s security or other users’ rights.

Users who upload handwritten-signed documents to the PCUEL Web Platform implicitly grant the Operator the right to process their handwritten signature.

Operator’s rights and obligations

The Operator has the right to modify, limit, restrict or temporarily withdraw access to the platform’s services, and to suspend accounts that breach this document or applicable law. The Operator is obliged to ensure the protection of personal data, maintain infrastructure security and provide services in accordance with applicable law. The Operator must inform users about the collection, processing and storage of data, as well as about any changes to the Terms and Conditions or to the platform’s services. The Operator may not use users’ personal data for purposes other than those set out in the Privacy Policy and in accordance with applicable law.

Intellectual property

The content of the PCUEL Web Platform, including texts, images, logos, graphic materials, databases and software, is protected by copyright, trademarks and other intellectual property rights. Users may access, view and use the content only for non-commercial purposes and with proper source attribution. Copying, reproducing, redistributing or commercially using any content without the Operator’s explicit permission is prohibited. The Operator reserves the right to take legal action against persons who infringe these rights.

Personal data

The Operator processes personal data in accordance with Regulation (EU) 2016/679 and applicable national legislation. The collected data includes identification data, contact data, technical data and other data voluntarily provided by the user. The data is processed to provide services through the PCUEL Web Platform, to comply with legal obligations, or based on the user’s consent. Users have the right to request access, rectification, erasure, objection, data portability or withdrawal of consent. Limitation of liability

The Operator provides the PCUEL Web Platform services “as is” and does not guarantee continuous, uninterrupted or error-free availability. The Operator is not liable for direct, indirect, incidental or consequential losses resulting from the use of the PCUEL Web Platform or from other users’ actions. The user is responsible for how they use the information and services made available.

Force majeure

The Operator cannot be held liable for failure to perform its obligations in the event of exceptional, unforeseeable and unavoidable events, such as natural disasters, cyberattacks, major technical issues or other force majeure situations.

Applicable law and jurisdiction

This document is governed by Romanian law.

Any dispute arising from or in connection with the use of the PCUEL Web Platform will be settled amicably; if this is not possible, it will be referred to the competent courts in Romania, with subject-matter and territorial jurisdiction.

Updates to the Terms and Conditions

The Operator reserves the right to amend, supplement or update this document at any time in order to align with legislative changes, applicable regulations, the evolution of services offered through the PCUEL Web Platform, or recommendations of competent authorities. Any changes will be communicated to users by publishing the updated version of the Terms and Conditions on the PCUEL Web Platform, indicating the last updated date. Users are invited to review the Terms and Conditions periodically to stay informed about any changes. Continued use of the PCUEL Web Platform after publication of an updated version constitutes tacit and express acceptance of the new terms and conditions of use.

Where changes require additional consent or specific actions from the user (for example, acceptance of new rules regarding personal data or cookies), the Operator may request the user to explicitly confirm acceptance through a clear mechanism such as a pop-up or notification message upon the next login.

The Operator may also establish transitional periods for implementing changes, during which users are informed and guided regarding new obligations or rights.
